Stuart is part of Shulmans’ planning team, working closely with Head of Planning Amanda Beresford on all contentious and non-contentious planning issues.
Stuart has extensive experience in the areas of planning, highways and rights of way.
Stuart deals with issues in respect of proposed developments including planning agreements, planning enforcement, proposed lawful development and planning policy. This includes drafting and negotiating complex agreements under Section 106 of the Town and Country Planning Act 1990 and under Sections 38 and 278 of the Highways Act 1980. In addition, Stuart has also sat as legal advisor to several local authorities’ planning committees and advised members on matters relating to planning law, members’ interests and probity.
Stuart’s experience also includes:
Defending judicial review claims against local authorities in respect of grants of planning permission
Managing proceedings in respect of planning appeals including instructing counsel and negotiating planning obligations
Acting as advocate at rights of way inquiries
Providing advice to officers with regard to minerals permissions
Advising officers with regard to matters relating to planning policy, including matters relating to the potential implementation of the Community Infrastructure Levy (CIL)
